Conditions. Saxon Parts reserves the right to amend these Terms & Conditions at any time without prior notice.
The latest published version on the website shall apply.
By making payment of any invoice, quotation, deposit, order, or service issued by Saxon Parts, the customer
expressly confirms that they have read, understood, and accepted the latest version of the Saxon Parts
Terms & Conditions published on the website at the time of payment. No separate signature shall be required
for these Terms & Conditions to become legally binding.
The websites kugelfischer.nl, ferrari-parts.nl, and bmwclassicparts.nl operate under the commercial and invoicing
entity Saxon Parts.
All sales, repairs, quotations, invoices, shipments, and agreements are exclusively subject to the Saxon Parts Terms
& Conditions.
2. MOTORSPORT / OFF-ROAD USE
Unless explicitly stated otherwise in writing, all products sold by Saxon Parts are intended and sold strictly for
motorsport, racing, competition, off-road, prototype, or show (concourse) use only. Products may not comply with local
road-use regulations, emissions standards, safety requirements, homologation rules, or inspection requirements
applicable in the customer’s country. The customer is solely responsible for determining whether products may
legally or safely be installed or used on public roads or specific vehicles.
3. PRODUCT INFORMATION & FITMENT
All descriptions, specifications, photographs, OEM references, compatibility information, VIN/chassis references,
and technical information are provided for general informational purposes only (website, social media, phone, digitally,
email, quote, invoice)
Pictures shown may not represent the exact item supplied. Compatibility, fitment, software compatibility, coding
requirements, and intended application remain solely the customer’s responsibility. The customer remains fully responsible
for verifying, fitment, compatibility, OEM reference numbers, VIN/chassis applicability, and intended use prior to purchase
and installation.
4. TECHNICAL GUIDANCE DISCLAIMER
Any advice, recommendation, setup information, tuning guidance, or technical assistance provided by Saxon Parts is
non-binding and intended solely for general informational purposes. Saxon Parts does not guarantee the accuracy,
completeness, or suitability of such information for any specific vehicle or application. Customers are strongly
advised to consult a qualified specialist or professional mechanic before installation or use.
No rights can be derived from these, unless expressly agreed otherwise in writing.
5. WARRANTY DISCLAIMER
Unless explicitly stated otherwise on the invoice as “new & warranty”, all products are sold strictly “as is”, “with all
faults”, and without any express or implied warranty. Saxon Parts expressly disclaims all implied warranties
including merchantability, fitness for a particular purpose, compatibility, durability, road legality, emissions
compliance, or performance. Used, rebuilt, refurbished, custom-made, motorsport, racing, fuel-system, and
electrical/electronic products are sold without warranty unless explicitly agreed otherwise in writing.
Used parts may show cosmetic wear, unknown mileage, prior race usage, or signs of previous installation.
6. RETURNS & CANCELLATIONS
Custom-built, made-to-order, special-order, motorsport, racing, fuel-system, electrical, electronic, ECU, module,
sensor, coding-related, refurbished, rebuilt, and used products are non-returnable and non-refundable unless
otherwise required by mandatory law. Electrical and electronic products cannot be returned once installed,
programmed, connected, modified, or supplied.
By placing an order, the customer expressly acknowledges that products designated as custom-built, made-to-order,
motorsport or special-order are procured specifically for that order and are excluded from cancellation and return
rights to the extent permitted by applicable law.
Returns are accepted only with prior written authorization from
Saxon Parts. Authorized returns may be subject to restocking fees and must be returned at the customer’s expense.
7. INSTALLATION & LIABILITY
Installation and use of all products are entirely at the customer’s own risk. Saxon Parts shall not be liable for
damage resulting from improper installation, incorrect tuning, software calibration, coding issues, inadequate
lubrication, insufficient cooling, improper torque procedures, misuse, racing conditions, or use outside
manufacturer specifications. Saxon Parts shall not be liable for any direct, indirect, incidental, consequential, or
special damages including engine damage, drivetrain failure, vehicle damage, loss of profits, labor costs, towing
costs, injury, death, race incidents, or third-party claims.
8. PRICING & AVAILABILITY
All prices are stated in Euro (€) unless otherwise specified. Prices, specifications, and availability may change
without prior notice. Saxon Parts reserves the right to correct pricing errors, typographical mistakes, inaccurate
product information, or stock discrepancies.
9. PAYMENT & LEAD TIMES
Payment in full and in advance is required at all times. No goods, products, repaired items, serviced items, or
completed work shall be released, shipped, collected, delivered, or returned until full cleared payment has been
received by Saxon Parts. Following full payment, Saxon Parts will make reasonable efforts to dispatch goods
as soon as reasonably possible. Lead times (production) are estimates only and may vary depending on supplier
availability, manufacturing schedules, transport conditions, customs procedures, workload, and third-party delays.
Made-to-order, custom-built, special-order, assembled, fabricated, refurbished, repaired, or crate-prepared
products may require additional production, preparation, testing, packaging, repair, inspection, or crating time prior
to shipment. Where wooden crating, export packaging, palletizing, or special transport preparation is required,
additional lead time shall apply. Deposits, reservations, and pre-payments are non-refundable if the customer fails
to complete the transaction. Fraudulent chargebacks, unauthorized payment disputes, or false delivery claims
may result in debt collection and legal action.
10. SHIPPING & INTERNATIONAL SALES
Shipping costs, customs duties, VAT, import taxes, brokerage fees, insurance, and related charges are the
customer’s responsibility unless explicitly agreed otherwise. The customer acts as importer of record unless
agreed otherwise in writing. International shipments may be supplied under EXW, DAP or other agreed
Incoterms®. Risk of loss, delay, theft, customs seizure, or transport damage transfers to the customer upon
shipment or carrier collection. Customers are responsible for arranging transport insurance where required.
11. RETENTION OF TITLE
Ownership of all goods remains with Saxon Parts until full payment of all invoices, shipping costs, taxes, and
related charges has been received.
12. B2B & CONSUMER SALES
Business customers acknowledge that purchases are made for professional or commercial purposes. Nothing in
these Terms excludes mandatory statutory rights granted to consumers under applicable law. Where legally
permitted, liability limitations and warranty exclusions shall apply to the maximum extent permitted by law.
Any goods delivered to Saxon Parts for inspection, repair, refurbishment, modification, testing, storage or
any other service are received and held entirely at the customer’s risk. Unless expressly agreed otherwise in
writing, Saxon Parts does not maintain insurance coverage for such goods against theft, loss, fire, water
damage, vandalism, accidental damage or any other cause. Customers are solely responsible for obtaining
and maintaining adequate insurance coverage for their goods during transportation to and from the Saxon Parts
and for the entire period such goods remain in Saxon Part’s possession, custody or control.
13. REPRODUCTION & CUSTOM-MADE PARTS
Many parts supplied by Saxon Parts are reproduction parts, remanufactured parts, Motorsport parts, or parts
produced in small series. Vehicle manufacturers such as Ferrari, BMW, and others often introduced undocumented
production changes during a model’s production run (street and race cars). As a result, it is not always possible to
determine the exact specification applicable to every vehicle.
The customer acknowledges that minor modifications, adjustments, fitting work, or the use of alternative
components may be required during installation. Examples include, but are not limited to, the use of reducers,
adapters, alternative hose diameters, modified fasteners, or minor fabrication work where original components
are no longer available.
The customer is solely responsible for verifying compatibility and suitability prior to installation.
Due to the custom-made nature of these products and the possibility of required fitting adjustments,
reproduction parts, made-to-order parts, custom-manufactured parts, and specially sourced parts are
non-returnable and non-refundable, unless defective due to a manufacturing fault.
Installation costs, modification costs, workshop time, transport costs, and any consequential damages are
expressly excluded from any claim against Saxon Parts.
Parts that have been installed, test-fitted, modified, painted, coated, welded, machined, or otherwise
altered cannot be returned under any circumstances.
14. PRIVACY
Saxon Parts processes personal information in accordance with applicable privacy legislation including the
GDPR/AVG. Personal information is used solely for order processing, invoicing, shipping, communication, fraud
prevention, and customer service purposes. Saxon Parts does not sell personal information to third parties.
14. FORCE MAJEURE
Saxon Parts shall not be liable for delays or failure to perform resulting from circumstances beyond reasonable
control including supplier shortages, transport disruptions, customs delays, strikes, sanctions, cyber incidents,
natural disasters, governmental measures, or force majeure events.
15. GOVERNING LAW
All agreements, transactions, and disputes shall be governed exclusively by Dutch law. The United Nations
Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.
16. INTELLECTUAL PROPERTY & TRADEMARK DISCLAIMER
Saxon Parts is an independent aftermarket and motorsport parts supplier and has no affiliation, association,
authorization, endorsement, or official relationship with Ferrari, BMW, Mercedes-Benz, Lamborghini,
Maserati, FIAT, BOSCH, Magneti Marelli, or any other vehicle manufacturer, brand owner, or automotive
company unless explicitly stated otherwise.
All manufacturer names, vehicle model names, OEM references, trademarks, logos, trade names, and product
images are the property of their respective owners and are used strictly for identification, compatibility, reference,
and informational purposes only.
The use of such names, trademarks, references, or images does not imply any official approval, sponsorship,
partnership, or endorsement by the respective trademark holders.
